Distance Sales Agreement

Article 1: Parties

BUYER

The person or organisation that makes the payment for a BüyükNet customer account. The BUYER's identity and contact details are those recorded in the BüyükNet customer account.

Article 2: Subject

The subject of this agreement is the sale and performance of the electronic service (web hosting, domain name, server, SSL and similar) that the BUYER ordered through the BüyükNet customer account and pays for on this page. The nature, term and details of the service are stated on the related invoice and service page.

Article 3: Price and payment

Payment is made by credit/debit card or by bank transfer (havale/EFT) through the payment institution PayTR Ödeme ve Elektronik Para Kuruluşu A.Ş. If instalments are offered for card payments, the instalment interest is shown on the payment page and is borne by the BUYER. Card details are not collected or stored by the SELLER.

Article 4: Performance

The service is set up electronically after the payment is approved, and the access details are sent to the BUYER's BüyükNet customer account and e-mail address. There is no physical delivery and no shipping cost. Set-up times are listed on the Delivery and Returns page.

Article 5: Right of withdrawal and its exceptions

If the BUYER is a consumer, the BUYER may withdraw within 14 days. Under Distance Contracts Regulation art. 15/1, the right does not apply to services performed instantly in electronic form (point ğ) or to services whose performance started, with the BUYER's approval, before the withdrawal period ended (point h). By paying, the BUYER approves that performance starts before the withdrawal period ends. Domain registrations cannot be refunded once they have been submitted to the registry.

Article 6: Obligations of the parties

• The SELLER must provide the service in line with the agreement and the applicable law.
• The BUYER must give correct and current information, keep access details confidential and use the service lawfully.
• The BUYER is responsible for payments made without the cardholder's approval.

Article 7: Failed payment and refund

If a payment fails or is not approved, the ordered service may not be set up or may be suspended. If an approved payment is refunded, the price is paid back up to the refunded amount, and the related service may be ended according to the scope of the refund. Article 8: Personal data

Personal data is processed under the Privacy and KVKK Notice.

Article 9: Evidence agreement

The parties agree that electronic records under this agreement (payment records, server logs, acceptance records) are conclusive evidence under Code of Civil Procedure no. 6100, art. 193.

Article 10: Dispute resolution

For disputes arising from this agreement, the Consumer Arbitration Committees and Consumer Courts at the BUYER's place of residence are competent within the monetary limits announced every year by the Ministry of Trade. If the BUYER is not a consumer, the courts and enforcement offices at the SELLER's place of residence are competent.

Article 11: Entry into force

The BUYER accepts this agreement electronically by ticking the box on the payment page which states that the agreement and the Pre-Information Form have been read. The agreement enters into force at the time of acceptance; the accepted version and the time of acceptance are recorded.
